On a single monitor desktop, I've found this problem more prevalent with Unity+Cube than Unity+Wall desktops.
Unity+Wall usually does not show the panel while a window is in full- screen. Unity+Cube almost always shows the panel on top of all fullscreen windows. Also, I noticed another potential communication problem: "on top" (3d) meaning "layered on top" looking down the z axis. this could also be said as "in front" "on top" (2D) meaning "located at the top of the screen" on the x axis. the unity panel resides at the top of the screen. The panel is visible "on top" (3d) of fullscreen windows.
