Same is happening to me, went from 10.04 to 12.04. I did a little bit of
testing and I could single out the instance when this happens:

1) Open Nautilus, set view as list.
2) Without previously selecting any item, right click on any item's line but 
NOT over the file/document's name.
3) The item does not get selected, and the right click menu appears as if you 
clicked on a blank space, not recognizing the item's right click menu (ie Open 
With, etc)

If you right click over the name of the file/folder, then the item gets
selected and menu shows up. This is why it seemed random to me until I
figured out the behavior, and makes it an annoying bug for folders
containing items with short names.

Hope this can be replicated/fixed soon!
