I've just tested 3.5-rc6 [0]. Since neither unionfs or aufs are included in the packages the install fails.
But now I get "read-only filesystem errors" and I can actually chroot into the NFSroot and open or execute commands without the "Not a directory" error. So I guess it's really fixed upstream.
