3 steps to reprduce it:

 1. Open emacs window.
 2. Grab the title bar and drag it up to the top margin of screen as possible 
as you can.
 3. Drop the mouse.(During the dragging process, you would see an outline or 
color change and don't drop the mouse until the outline disappeared.)

Sometimes you could succeed to drag the emacs' menubar totally into the top 
panel and you would see the emacs' menubar is  underneath the top panel. I also 
tried doing the same thing on windows7.Dragging a window's title bar to the 
upper margin until the title bar is out of screen,it automatically returned 
into screen after i dropped the mouse.
FYI, i'm running ubuntu 12.04 in virtualbox 4.1.18. When the bug appeared,i had 
to change the size of virtual machine's window and then the menubar displayed 
again.
