Adam, dug more into the lsb spec, and found this:

So, in technicality, the script does as specified under that
determination, making a pid file always outweight validity of any kind,
so this is a debate I will need to take with the LSB group otherwise.
As-is with this correction done, it fixes the main problem while staying
completely in spec.
