Ok so I tried this with the 3.2, does not work anymore either, constant crashes.
The only that changed was upgrading the distribution from precise to quantal,
since then the problems exist.
So it is not a kernel issue per se, but a drm mod problem.
Unfortunately I am not sure how to easily downgrade to another
xvideo-xorg-video-intel without screwing up my whole distribution. But that is
where the bug resides.
I did not see any newer package on the xorg(testing) page, besides the one in
quantal.
Is there a way that I could downgrade to the precise drivers? (I guess not
without changing the whole X installation :( )

** Package changed: linux (Ubuntu) => xserver-xorg-video-intel
