@Matt Yeah, I've received a couple "driver doesn't compile" emails recently for the newest kernels. See this issue on Arch Linux https://aur.archlinux.org/packages/psmouse-alps-driver with an appropriate work around. I don't plan on moving to a 3.5+ kernel in the near future and I have not heard ANYTHING about my patch submissions being accepted so I think submitting a patch with your 3 argument changes may be a little premature.
My suggestion is to create a new issue on the Ubuntu launchpad for the three argument problem, document your work around and point to this and the Arch Linux bug report. BTW, I saw that Linux Journal picked Dell as the best Linux vendor.
