The bug still is in 12.10 installed on my Shuttle XS35V2.
After every Kernel-Update I have to install the driver to get network access, 
that's really annoying.
I use these commands to install, got them from the net:

> sudo apt-get install linux-headers-$(uname -r) build-essential
> wget ftp://driver.jmicron.com.tw/Ethernet/Linux/jmebp-1.0.8.5.tar.bz
> tar xvf jmebp-1.0.8.5.tar.bz
> cd jmebp-1.0.8.5
> make
> sudo make install
> sudo update-initramfs -u

Please fix it!
