According to the Linux kernel bug tracker related to this bug: http://bugzilla.kernel.org/show_bug.cgi?id=42690 this is not a bug of kernel, but it is a bug of the Ubuntu mainline kernel.
In brief, I tried a Debian precompiled kernel, and it didn't shows this kind of bug (but produce a different power issue, see the previous link to the whole description). So it seems to be a bug related to the patches applied from the Canonical Kernel Team on the vanilla kernel (and the bug on kernel.org is now closed).
