Thanks for the update, Philip.  It might be best to perform a "Reverse"
bisect to identify the upstream commit that fixes this.

Can you first test the latest upstream 3.8.12 kernel[0] exhibits this
bug?

If 3.8.12 still exhibits this bug, please test the 3.9 final kernel [1]
to confirm it resolves this bug.
