So the upstream 3.9 kernel does not exhibit this bug, but the 3.9.0-0.4
kernel does?  Can you update to the 3.9.0-1.5 kernel, which has been
rebased to upstream v3.9.1.

You should still be able to install and test  3.9.0-0.3.  You just need
to install the .deb and select it from the GRUB menu.  Testing
3.9.0-0.3 will tell us if one of the two Ubuntu SAUCE patches in
3.9.0-0.3 may have introduced this.
