I can now confirm this bug in 3.8.23, 3.8.22 and 3.8.21. The latest
kernel is also effected (see attached kernel.log):

However, with the latest kernel there is a slight improvement. The
system does not freeze anymore, but only kills the most memory consuming
processes in a cascade until it finally kills the X-server. At this
point it is possible to log into the shell and savely reboot with init
6.
