This looks like a bug that has been around for quite some time. I'll bet it's been inherited from kernel 2.4 or 2.6, since the available drivers from Realtek (http://www.realtek.com.tw/downloads/downloadsView.aspx?Langid=1&PNid=1&PFid=1&Level=6&Conn=5&DownTypeID=3&GetDown=false&Downloads=true#RTL8185L) have 2.4 and 2.6 on the Makefile.
