Using original package
virtualbox-4.1_4.1.12-77245~Ubuntu~precise_amd64.deb from upstream gives
exactly the same error. In changelog, seems version 4.1.24 merge fixes
for 3.8 kernel (https://www.virtualbox.org/wiki/Changelog-4.1):

I've installed virtualbox-4.1_4.1.24-82872~Ubuntu~precise_amd64.deb from
upstream, and works OK. No error at instalation
