ok so here is what the problem was, when I said the only thing I did was
start using the evdev driver I forgot that I changed something else in
xorg.conf and once I changed it back I no longer have a problem

with that in mind, I wonder if it is just that it is unsupported by my
video card, or I can't have both on at once as they do the same thing
maybe, or is it still a bug?? please let me know
