like Ron said, if I boot into CSM mode ( which I think is legacy bios), the 
sound works fine. I did that using a live usb. So seems to me this bug is more 
connected to the boot mode than the driver itself. maybe there is some command 
line parameter that we can set in grub default and get this fixed. 
By the way I booted using the secure mode on and off in the UEFI mode, both 
cases yielded no sound. However, with live usb I was able to get sound even 
with 3.9 kernel.
I really do not want to go through installing the os again, please comment on 
this new information and let me know what I can do to mitigate the problem
