I have written to the kernel development mailing list and now the
issue is solved in mainline from kernel 3.10.0. I'm not able to test
it because I don't use ubuntu anymore but looking at the kernel
version I can say that it is solved. Only  kernels between 3.5 and
3.10 have this problem, if I remember well, and there are some patches
that you can apply on these kernels to solve the problem:
