I've dont more testing and i noticed that using 331.38 drivers if i resize windows with the new live resizing if i go slowly the window blinks dark and if you go really slow and stop when it blinks black, you can get the window to stay black... with this i assume this bug has been there for awhile but the new driver just made it worst.
