This is a great question. Unfortunately, I'm not a kernel developer, so I don't have deeper insight on this. However, in order to get this fixed so you wouldn't have to use the kernel parameter, it would be best to report this upstream through the appropriate channel by following the instructions at https://wiki.ubuntu.com/Bugs/Upstream/kernel .
