ubiquity doesn't blindly create an esp when you boot it in uefi mode,
which is why grub-install needed modified to fall back to grub-pc, since
installing grub-efi would fail. I suppose that if you boot in bios mode
and pick a side-by-side install on a disk that already has an efi system
partition then it could warn you.
