This looks like a bug in ath3k module.
You are correct. ath3k just loads the firmware. After that btusb can
handle the adapter.
If you upload the firmware to the adapter and then reboot, you do not need
ath3k again, or that patch.
It is because the firmware is already there.
The only thing is to fix that bug in ath3k.
