1. I've put an equivalent statement into the toolkit spec, subject to approval from Femma.
2. "Some content which is not accessible" should never be the case, whether the OSK is visible or not. That would be awful! As I mentioned, that could be fixed by implementing the Dialog section of the toolkit spec -- particularly the part where the body area scrolls if necessary.
