To clarify, you are downloading the latest version from
ftp://driver.jmicron.com.tw/Ethernet/Windows/ ?

If this is reproducible with the latest driver version from Windows, you
could call the manufacturer to inquire about if there is a firmware
update that could be applied to fix this problem. If not, you could
request a replacement of the same model where they updated the hardware
to do as advertised.

Circling back to linux, a quirk could be added that automatically
invokes the WORKAROUND you noted in your Bug Description, given it
doesn't just work when you plug it in.
