You identify two issues. First, "popping up a window does NOT provide a
persistent state of notice". That's true in that you can dismiss the
dialog without restarting. But if you do, per spec, it will come back a
day later, just as it would if you hadn't installed the updates at all.

Second, that the current design "breaks the logical connection and
Unity-design of displaying system related events in the Upper-Right
corner of the panel". But there is no such connection or design. And
even if there was, that would not be an excuse for shipping designs that
don't work.
In particular, there is no evidence that "The power-cog turning red
alerts the user's attention to the event" for a reasonable proportion of
users. On the contrary, when use testing was done on systems that
happened to need system updates, nobody noticed the updates icon in the
panel. That's the reason we changed the notification of updates
available from an indicator icon to a dialog in 2009. It's implausible
that the appearance of a new icon would fail to notify people that
updates were available, but that changing the color of an existing
indicator icon -- even less of a change -- would succeed in notifying
people that their system needed restarting.
It did use to be the case that the power menu title went red when
updates required a restart, and that the menu contained an item "Restart
to Complete Updates". But there was never any evidence that that worked,
either, and it was removed in 2012 along with printers and webcams and
other stuff that didn't make sense in that menu.
