I flashed my test device with --wipe, and I can observe the issue described here. The OOBE wizard uses an unmodified Ubuntu WebView (https://bazaar.launchpad.net/~unity- team/unity8/trunk/view/head:/qml/Wizard/Pages/here-terms.qml#L115), which uses a ListView inside a Popover for the item selection (https://bazaar.launchpad.net/~phablet-team/webbrowser- app/trunk/view/head:/src/Ubuntu/Web/ItemSelector02.qml). Delegates inside that listview have no special theming applied, they use a stock ListItemLayout.
