The bug is gone for me since

linux-source-2.6.15 (2.6.15-26.46)
  * Cherry pick fix for HP laptop batteries.
    - Malone: #47561
    - GIT SHA: 49fee981fa98f3c0a21f3d6c8193eddcc15e84e9

This is also the reason, why i don't provide the kernel-image anymore.
