Thank you for looking into this: your results confirm my theory.
Indeed the rules are racy so the result depends on the ordering of events.
Your fix seems correct, however we're going in another direction:

We got feedback that the Ubuntu certified laptops with hybrid graphics
all got certified with Xorg because that's what they were inadvertently
defaulting to at time of certification. To honour that we're going to
make sure that we keep defaulting hybrid laptops to Xorg (just like we
default nvidia desktops to Xorg).

I had prepared some patches for that just yesterday... :)
