Thanks Alan yeah I implemented a solution based on your suggestion using
preseeds curtin_userdata_ubuntu and it works as expected .. my preseed
contains a late-command to fetch and execute a sh script from github..
the sh script from github downgrades cloud-init package accordingly,
depending on which ubuntu codename release is detected (/etc/os-release)

I wouldn't characterize this as RESOLVES my issue.. as I consider this
workaround temporary.. to me resolved would be cloud-init fixed and
avail in latest ubuntu cloud images such that this workaround isn't
needed any longer

thanks again for the fix suggestion, this definitely buys some
time/breathing room for me
