Hello! Thank you for opening a bug report. This is, however, intended behavior, and as such won't be changed.
When consent is false, Ubuntu Insights will still generate an "opt-out" notice. The content of this notice is minimal, essentially just a static item that says "opt-out". The uploader will also turn reports that were generated with content into these "opt-out" reports if at the time of upload attempt you've opted out. The reason for this behavior is that it is helpful for us to know the proportion of people that are opting out. You can see for yourself what Ubuntu Insights is generating and sending in `~/.cache/ubuntu-insights/linux`. The README in https://github.com/ubuntu/ubuntu-insights also provides some more context on what information is generated and sent.
