I can confirm this. The reason seems to be, the hardy-kernel-config where the option CONFIG_CPU_FREQ_DEFAULT_GOV_PERFORMANCE is set instead of the former (gutsy) set CONFIG_CPU_FREQ_DEFAULT_GOV_ONDEMAND.
