As for legality, I am not a lawyer, and so this analysis may be flawed (if so, please correct me!), but as far as I can see this would be no different from the situation with things like the nvidia kernel module. Clearly ZFS is not a derivative of the linux kernel - what with it not even working there at all at the moment.
