I think this is probably fixed by this change in ubiquity 1.8.6:
* Fix partition_too_small check only to warn about partitions that are not
free space, are not marked as "do not use", and are marked for use with
a filesystem.
... but would appreciate retesting once daily builds with that version
are available.
