I see that the file in
https://launchpad.net/ubuntu/hardy/+source/hal/0.5.11~rc2-1ubuntu7/+files/hal_0.5.11~rc2.orig.tar.gz
have this problem.

Intrepid version (older!?) does not have this problem, because it allows
it always.
