As a reporter of a bug marked as identical, I'm concerned that the bug I reported is not "identical".
Take a look at http://www.bbc.co.uk/ at the top right-hand side, and you'll note that the clock has an unpleasant black background (unlike Windows/Mac). It should be a mostly transparent clock. To my view, this is immaterial as to whether Flash is "on top" (don't care in this case as long as transparency works).
