well.. I'm a little sheepish to admit that I got so desperate that I logged in to Windows.. in the back of my not so technical mind was the possibility of the thought... "try it in Windows and see if it's that cheap-shit mouse broken already, even though it has some worthless lifetime warranty"... it did not work in XP.. a few wiggles later something was happening.. and then it dawned on me..
