Good news. A fix ( http://git.kernel.org/?p=linux/kernel/git/torvalds/linux-2.6.git;a=commit;h=4b4f7280d7fd1feeff134c2cf2db32fd583b6c29 ) which works around for this issue went into 2.6.26 that resolves this issue. Obviously this problem is still seen on current Hardy kernels.
