This isn't fixed in Hardy. It is still there in the applet and the
volume control.
gnome-alsamixer doesn't have a problem, but the gstreamer-based volume
control applet and gnome-volume-control still do. I have tried this on
two computers with Hardy and it still happens with Intrepid too with two
different sounds cards (a C-Media-based Turtle Beach Montego DDL and an
Audigy2). I've tried all the patches and spent 6 hours debugging the
problem on my own. It seems that the audio driver is giving me random
values for volume indicating a problem at a lower level but I am
certainly not sure this is the case. alsamixer and gnome-alsamixer work
fine. So while the bug may not be in gnome-applets there is certainly a
bug somewhere for some of us.
