Seems as if the Dapper apache2-common does create/touch the files /var/log/apache2/{error,access}.log.
I've also taken a closer look at the apache2 logrotate. Can't make it to do away with {error,access}.log, which I guess makes sense considering the notifempty option. Not sure if there is anything else I can do unless you help me by showing how to recreate the problem.
