The main "problem" here is that fglrx doesn't want to install on a kernel newer than 2.6.32. However we can't expect the Ubuntu devs to support other kernels than the ones shipping with Ubuntu. I would suggest you to file bugreports with the problems you have using fglrx on the official 2.6.32-kernel so these can be addressed. This'll be much more effective than trying to get fglrx to run on unsupported kernels.
