THE JUDICIARY OR STATE IS CORRUPT?
- IS THE JUDICIARY CORRUPT? The answer as per opinionated empirical evidence in grave criminal acts is NO. The judiciary is a state institution, which therefore, plays a vital role in legitimating the activities of the state on the citizens.
- Therefore if the judiciary is corrupt the state is corrupting the judiciary.
- LAWS IN UGANDA AND FOR WHO- TO PROTECT THE POWERFUL OR THE WEAKEST OF SOCIETY? To this question, I will leave it to you, as professional taxpayers wage earners and legal representative of both the state, the citizens and the government of Uganda to answer.
- It is up to you to show to the world and Ugandan citizens in particular that the institutions you represent have legally directly or indirectly adequately explained and settled the following.
- 1. Let Uganda parliament under your guidance, demand the present government of Uganda, to publish the Uganda police and central investigation department (CID) investigations and / or any other security agency report or findings, into the murder of the former 1995 constitutional head Professor Dan Mudoola, in its entirety.
- 2. The government should with immediate effect publish the entire investigation report in rebel leader Sarah Nabakooza, suspected to be an Allied Democratic Front (ADF) rebel commander who was charged before Buganda Road court with the murder 20 Kichwamba Technical College students on June 6, 1998.
- 3.Your government should publish a dossier detailing Uganda People's Congress plans, order and execution of such plan with intention to murder the citizens of Uganda in Luwero or else where in Uganda other than as the consequences of the war which your government started in Luwero. In such a dossier detailed information should be given who in UPC planned and where, ordered, and carried out such a programme.
- 4. Your government, the government of Uganda on your guidance should release the commissions of enquiry report into Luwero killings and let that report be translated into local languages and distributed thereupon to the victims of those killings and/or to people or society it is directed to.
- 5. Since Uganda is said to be democracy- with a parliamentary representation - It will be of outer most importance and in Ugandan's interest in observance of the laws Uganda, that the institutions, which you represent on behalf of the citizens and the government of Uganda publish a fullreport and your government investigation into what exactly happened on the fateful day in a plane crash in which a Uganda Peoples Defence Forces (UPDF) Col. Jet Mwebaze died.
- 6. Let the government of Uganda under your wise and learned guidance, explain to the people of Uganda conclusively, with detailed documented evidence of what was going on in Eastern Congo and Western Uganda during the so- called Allied Democratic Forces (ADF) insurgency. Inclusively, the government of Uganda should explain fully; 2 a). the premeditated murder of 80 students at Kichwamba technical collage, 2. b). Disclose in full details the identities and leadership structures plus the entire background of the ADF leadership who are citizen of Uganda i.e. Henry Matovu, Abdallah Yusuf Kabanda, Jamil Mukulu, Wilson Kireru, Alirabaki Kyagulanyi, 'Dr.' Tom Otto alias Siraje Bogere, Dr. Shariff Benjamin Kisokeranio, Sarah Nabakooza, AND ADF former rebel fighter either captured or who surrendered to the Uganda peoples defence forces (UPDF) c). Explain the fate of the Lt. Rajab Kasozi.
- 7. ADF was/is linked to city crime, according to security agencies media reports, into this country. Indeed as we have been informed, former soldiers and veterans have been largely represented into these asocial activities. All of them are citizens of Uganda. It is therefore of crucial importance, that the security agencies since are functioning under the laws governing this country, and that they can offer to the media basic information about these people, that then they should be in full -knowledge of the individuals involved, which as a matter of social stability and security, a dossier including all names of such people who have met their death because of their involvement into these activities should be published and distributed to district centres nation wide. 3 a). The security agencies must by law also inform this citizen's representatives (Members of Parliament) of this country, through documented evidence, the number of criminals who have been recruited! by them (
security agencies) to help them track down the activities of these criminal groups. 3b) in details explain the conditions or terms of recruitment of these criminals into legal policing activities should be clearly stated. 3c). those who recruited these people should state in the clearest terms, under which Uganda laws such activities are/were suctioned and which courts of law legitimated such recruitment - as the case of a one robber police informer called Ssekiziyivu a resident and convict of Nakasongola prison and former student of Namilyango, who was killed in an aborted forex bureau robbery in Kampala mid 2002 and car robber Lt. John Mugaba alias Tony Golooba who was killed in the so called operation pearl blanket, June 2001
- 8.The government of Uganda should on your advise, come up with both criminological, medical, forensic evidence, and legal explanation in the death of citizens, public servants and army service men a). Ikondere, b). Jet Mwebaze, c). Brigade Frank Mwine (chefe Ali) d) Sserwanga Lwanga.
- 9.There is an array of public servants, within the armed forces who have met their deaths i in suspicious circumstance - all their names as the law requires, should be published and the nature of their deaths thoroughly explained, catalogued, and subsequent details debated by the parliament of Uganda.
- 10.Under the amnesty laws for former rebels - it will be in the best interest of your government to put in place legal procedure and framework to full extract information on all acts of violent criminality, i.e. ambushes of civilians traffic, torture and murder, which have and still taking place in Acoli, Teso and the surrounding regions, how those acts were conducted and PRINCIPALLY who order them.
- 11.Uganda Peoples Congress ( UPC ) as it has transpired into the recent past- has many times, again and again showed interest in coming up with evidence of systematic murder of her members around the country. It will therefore be in the interest of your governmental institutions, and indeed the citizens of Uganda, law enforcing forces (the police), the judiciary and the laws of this country in particular, to encourage or adduce evidence from UPC, to know the truth about these murders as claimed by UPC and to subsequently convict as per the laws of Uganda established, those who carried them out and those who directed them. Murder is punishable under the laws of Uganda.
- 12. The same principal must apply to Uganda's democratic party DP which in fact did popularise it so -called black book which by international laws on human rights to which Uganda is signatory should be produced henceforth.
- 13. There are several Uganda citizens who have stolen huge amounts public funds and sought sanctuary in foreign countries like the UK and USA- those countries have on more than one occasion sought criminals from their country hiding into Uganda, which in reverse will imply that Uganda can ask them assistance to extradite people who have stolen public moneys and are hiding into their countries- could the judiciary explain in the clearest terms why those Ugandans, who free to the UK and USA with public funds can't be brought back to face the law of this country?
- 14. The government of Uganda on your advise should with immediate effect release the Scotland Yard report into the murder of Andrew Lutakome Kayiira plus a full detailed report on the reason which lead to the his imprisonment including Uganda's security agencies own investigation into this murder.
- 15. The judiciary, the police force and the government should explain fully why the Ssebutinde inquiry report exposure in murdered and attempted murder cases in and within he police forces have not been prosecuted by the courts of laws mandated with powers to do as in the case of Kiddu and drug peddling.
- 16. Explain in full details, why this case never came up into the courts of law. Or if it did publish the deliberation in full. Local defence forces are recruited on behalf of the state, therefore the state is responsible for their acts. [Between 11 p.m. and 12 p.m., Friday May 11 1990 a 23, twenty three year old woman by the name of Josephine Christine Namutebi, a resident of Kitintale or Luzira and school teacher of Kitintale, daughter of Mr. Mukasa was murder by about one or several of the 10 ten Local Defence Unit (LDU) in Kitintale Nakawa division at a road block, which the said 10 Local Defence Unit which is said to have been staged at 8.00 p.m. on the said date of murder. The victim Josephine Christine Namutebi, is said to have been coming from her boyfriend's home walking towards Luzira when the one of or all men (10) Local Defence Unit stop her at the road at around 11.00 p.m. and 12.00 p.m., Friday May 11 1990. e witness around the murder scene, asked Josephine Christine Namutebi 23 years to identify her self to which Josephine Christine Namutebi 23 years, asked one of the Local Defence Unit (LDU), " Don't you know me, why don't you ask my identity card?" The said Local Defence Unit LDU man/men attempted to strip Josephine Christine Namutebi of her cloth. In the scuffle, which followed according to sources, Josephine Christine Namutebi tried to escape. One or some of the Local Defence Unit (LDU) men cased her and caught up with Josephine Christine Namutebi. He /they dragged Josephine Christine Namutebi near the home of a one Mama Sofia before she started to raise an alarm. In the commotion, which followed, sources say several men or all the LDU at the said roadblock shot and instantly killed Josephine Christine Namutebi.
- 17. Your government should explain the sources of funds, which were used in financing Lurent Kabila soldiers in the Congo - and thus state clearly explain the total contribution from the Ugandan tax-payer. This information should accordingly be scrutinised by the offices of the accounting general of government (AG), the government public accounts committee, the budget committee and then debated by the parliament of Uganda.
- With developments in international law and justice to, which Uganda is a signatory, modern communication infrastructures, increasing awareness among the citizens of Uganda in and outside the country, it is futile and self-defeating on side of the state, the government of Uganda and its functionaries NOT to publish those reports and thus act legally upon them.
As I have shown before- the international legal fraternity have shown interest in Uganda's case, to, which considerable amount of advice has been offered thereupon in circumstances where conclusive flux of events have be attained.
