Govt Ordered To Pay Sh66m Over CMI Torture

THE Government has been ordered to pay sh66.5m to a trader who was illegally arrested and tortured for nearly four months by the Chieftaincy of Military Intelligence (CMI).
Human Rights Commissioner, Veronica Eragu Bichetero, held the Attorney General liable for violating Fred Bagole�s rights to liberty and protection from torture, cruelty, inhuman and degrading treatment.
The tribunal heard that Bagole, 29, a resident of Kidiki village, Namwendwa in Kamuli was one of the passengers pulled out of a Jinja-bound taxi by CMI operatives near the Namanve Coca-Cola plant on May 5, 2001, over something best known to their captors.
After he was transferred to a car with tinted glass and driven back to Kampala, two of them were apparently shot dead at the Fairway Hotel roundabout in Kampala and their bodies dumped at the Golf Course. Bagole was driven to CMI headquarters on Yusuf Lule Road.
Medical evidence shows that Bagole was rendered impotent after his right testicle was removed. He also has scars all over his body where he was beaten with a blunt instrument.
He lost a tooth in the lower jaw and suffered mental trauma.
Dr. Samuel Nsamba of the African Centre for the Treatment and Rehabilitation of Torture victims testified.
�I am of the view that the actions of CMI officials who detained and tortured the complainant were inhuman, degrading, and not acceptable by the laws of Uganda,� Bichetero ruled.
Bagole (left) said his captors hit his body and joints with a gun barrel and a hammer to make him �talk�.
�At one point he was ordered to strip naked and his testicles were repeatedly pierced with a needle and a syringe for about 15 minutes,� the tribunal heard yesterday.
