Museveni Panics over Besigye Petition

President Museveni is panicking over the petition filed on Tuesday by Presidential Challenger Dr. Kizza Besigye. The petition is seeking to lay bare the kind of bribery, vote rigging and intimidation used by President Museveni to win the 2006 presidentia

If successful, the petition may even lead to overturning the results of the Presidential elections and ram elections observers reports back down their throats.

27 lawyers are working on the petition led by Dan Wandara Ogalo and former Law Society President John Matovu. It is this line up of learned men that have got the ‘White House’ Entebbe in panic and disorder. It seems these men are determined to bring down the roof on Museveniville and force the President to put back the cocks on the Champaign bottles. It seems like cerebrating victory was pre-mature.

The President is finally taking the Besigye legal team seriously. He has in return hired 50 lawyers to defend his fraudulent win. Information coming out of the Besigye legal camp is indicating that the Besigye team has evidence to demonstrate that rigging cost the opposition more the 600,000 votes. This is the number of votes the president got more than his challenger to avoid a run-off in the presidential race.

The line up of 50 lawyers is far h igher than Bill Clinton employed to fight the Monica Lewinsky scandal and impeachment. OJ Simpson, the famous American football star had 6 lawyers to fight against the prosecution that he allegedly murdered his wife Nicole and her friend Goldman. The president’s actions contract sharply with his post election attitude when in buoyant mood he dismissed the petitioners as not being able to ‘go very far’.

All together, 77 lawyers are working on Uganda’s Presidential elections dispute. Far higher than the number employed by Bush-Gore during the 2001 disputed American Presidential elections.

The number of lawyers involved in this case suggests that both sides are serious about what they’re doing. From an independent observation, the President is the most worried Man. He’s the one to quash allegations that his party cheated at the elections.

As back up, the General Court Martial is threatening to overthrow the constitution by defying a high court order banning trial of civilians in a Military court for terrorism offences. Besigye has been summoned to appear in the GCM on March the 15th. If he doesn’t, he faces arrest and jail (see army may cause civil war).

Do not believe Museveni’s pronouncements that there will not be a Court Martial Trial involving Besigye and that his government is law abiding. Until Dr. Besigye receives documentary confirmation that the GCM has abandoned plans to try him, he should be ready for anything.

The Supreme Court know that they made an error of the law when they declared widespread electoral malpractices in the 2001 general elections, but then failed to overturn the result on the basis that the malpractices could not have changed the elections result. This was wrong because the purpose of widespread malpractices is to change the outcome of an election. Museveni knows this and is not taking any chances.

Don’t believe FDC’s portrayal of the petition as a humanitarian attempt. You don’t li ne up 20 lawyers for the purpose of charity. I think Dr. Besigye is determined to overturn these elections results and force another presidential race. Why shouldn’t he? Museveni has turned elections rigging into an acceptable habit. Unless he’s shown that it doesn’t pay; his NRM will continue to rig elections for another 100 years.

At the end of the day, we are looking at the Super bowl of lawyering and it is going to be more interesting than in 2001. UK Version will continue to analyse the presentations and keep you updated.
