just as the Civil Contingencies act allowed the gov't to do what they
want on the basis of a "threat", so calling something terrorism will
allow the gov't to target telecommunications providers at will.

One worrying phrase in the proposal is that the Act is can be used in the *detection* of crime. This implies to me that a warrant can be issued for the interception of traffic that is not known or suspected of be being used for criminal purposes - ie. they can intercept normal traffic and scan it to detect a crime. If a warrant can be issued in such circumstances then the safeguards do not safeguard anything.
