Dear friends and neighbors,

Once again, we come to you to request your help in signing a petition. This time, we are trying to get the city to get the owners of the property on the corner of Cedar Ave, Baltimore and 46th (where the Le Mandingue restaurant is located) to remove an illegal addition that represents a risk and liability to the neighborhood. At the end of this message I have transcribed the text of the petition. If you would like to sign please let me know, and a representative from the Cedar Point Park Neighborhood Association ( most likely me) will come by to your home with the petition.
A number of discussions about this location can be found on the archives of these list serves but if you have any further questions, please let me know and I will try to answer them to the best of my ability.

Petition:


The License and Inspection and Zoning files for 4610-12 Cedar Avenue were researched and the following facts were discovered:


1. The building add-on, which is now being planned for kitchen use protrudes over the 23 foot setback property line into the public and pedestrian walkway by an estimated eight feet.
2. The Zoning blue print drawing shows that the approved building for this 4610 address which is a little over 55 feet. The additional structure is not sited on the plans and makes the total length of 4610-4612 Cedar Avenue more than the designated 55 feet. This makes the add-on portion of the building illegal. (Blueprint available for review)
3. No approved permits or variances were found in the respective licenses and inspections or zoning files for the addition to be built at 4610-12 Cedar Avenue.
4. The building addition was built on top of the sidewalk and a slab of concrete, without a proper footing/foundation required by code or permit. (this was witnessed by neighbors as the gas company was putting in a line, and again when PGW repaired the sidewalk during September, 2003)
5. During 2003, an intake and power exhaust ventilator were put on the roof of the building addition. The exhaust violates the residential property line in two ways: a) the public residential set back line and b) the next door neighbor�s property line. If nothing changes and the restaurant opens, the neighbors will be exposed to noise and forced to breathe fumes, carcinogens and grease particles.


Based on the aforementioned information and attached documentation, the residents of the 46th and Cedar Avenue block and neighbors strongly object to this illegal structure and respectfully request that the unauthorized portion of the building be removed.
The removal of this portion of the building will then comply to the code of the 23 foot set back for Cedar Avenue and help eliminate the subsequent issues regarding this commercial building being directly adjacent to a residential block and its effect on the quality of life for the neighbors of 4600 block of Cedar Avenue.
