Note that these regulations WERE in effect for both the recent (2003) Mayoral Election and the Spring Primary.
The Philadelphia Election Commission just sent out a mailing to all Election Board Workers reminding them about both the Commission's training sessions (which they are supposed, but not required, to attend) and the "new" Federal and State requirements for this election.
Federal Law: October 2002 "Help America Vote act of 2002" P.L. 1207-252 (42 U.S.C. section 15301 et seq.)
Pennsylvania Law: October 2002: Act 150 of 2002
Any FIRST TIME VOTER in a polling place (not just new registrations, or those registering by mail, or with their Driver's License) -- will have their "Pollbook entry marked "ID REQUIRED."
This applies to ANY voter voting for the first time in a Division... either by new registration or by re-registration (move, change of address, change of name, etc.)
The preferred for of Identification is a Photo ID, however, the Voter's Registration card is an acceptable alternative. (There are about 15 different forms of acceptable ID.)
HOWEVER, if an elector whose form is marked "ID REQUIRED" can not or will not provide acceptable identification that elector must NOT be allowed to vote on the machine, and MUST vote via the paper "PROVISIONAL" ballot, completing all information required and SIGNING the affidavit which accompanies that ballot, TWICE, front and rear. Failure to sign appropriately will disqualify the ballot envelope!
Also.
Any elector who shows up at the CORRECT polling place and is not in the Pollbook, after following a defined procedure to determine WHERE their correct polling place is located (where they should be voting), MUST be allowed to vote on the paper PROVISIONAL ballot. (They may NOT be permitted to vote on the machine!) It is no longer necessary to go to Election Court to get a "Court Order" to be allowed to vote if you are not found in the Pollbook.
Education of Election Board members by the Election Commission is "spotty" at best. Education of Board members elected in "curbside" elections or of Poll Watchers and Ward Committee persons is virtually nonexistent! And the general public knows even less. This was VERY obvious during both the Mayoral Election and the Spring Primary.
