Listserv and Mr. Krigman, I decided to hold off on the complaint to the IRS until the conclusion of the UCD cover-up. Wendell's response to the UC Review questions certainly became the obvious point for a complete report to the IRS.
None of the insinuations against Mr. Fenton nor the release of standard personnel policies did anything to lessen the culpability of UCD for the violations of federal law first reported by the Daily News. As we have discussed on the list, the special favor or services policies were the policies relevant if any honest investigation was to be evaluated by the residents of this community or the IRS. The published ethics policy and use of UCD property policies were red herrings used in the insinuations against Mr. Fenton's character. They did nothing to lessen UCD organizational guilt. As discussed on the list, any honorable, reputable entity like UCD claims to be has a duty to have a formal policy for delivery of "special favors" to "the community." With his answers, Wendell publicly asserts that these policies vital to a legitimate investigation will remain secret. He asserts that the media caught only a single incident caused by Mr. Fenton's ethics. He asserts that the secret policy will be looked at, but will remain secret. The UCD cover-up has failed! For years, it has been obvious that the special services provided by UCD were policies of cronyism. While UCD is caught red handed, and the "Fenton investigation" supports that UCD has operated as an unethical corporate powerhouse bulldozing the community in support of the Penn marketing scheme; Penn cannot publish the policy for a corporate ruled gentrified zone as a buffer between its campus and resource starved Philadelphia. Similarly, a published policy in support of cronyism would be an obvious attempt at a push for policies of plutocracy. Add such a policy to the recently revealed "3 choice" paradigm for use of the civic association board leaders, and the Penn Trustees would be such obvious opponents to democratic principals in a way that could travel the globe! Penn is caught because it had no choice but to choose the cover-up and making a scapegoat of Fenton rather than an honest account of policy. I've noticed that cover-ups are often considered a worse crime than the original violations of corporate and business law. Had UCD been a special service entity rather than a front for Penn real estate interests, it could have claimed a single mistake over the Fenton affair and folks like myself might have looked like unreasonable complainers. Had it existed, all they had to do was publish the ethical and legal policy or protocol given to Mr. Fenton. Given the support Mr. Fenton, the employee, had in the neighborhood; he could have then apologized for a mistake that I believe would have been widely accepted as a simple mistake. Do you see the obvious contrast between honorable and transparent reactions and deceit, cover-up, and blame? It is my conclusion that a paper trail of evidence exists through the media reports to support a request to revoke the UCD non-profit status. No, a single incident by an honorable special service entity probably would not have warranted IRS action nor a forced resignation of Mr. Fenton either. However, the subsequent cover-up will be obvious through the most basic investigation of the media reports, and this does warrant serious action. It is now safe to assume that UCD has operated unethically and illegally for years. Neighbors like myself have attempted to inform the community of UCD activities with Land I, trash tickets, BID, Clark Park, etc. for a long time. In each of these individual actions against segments of the community, we whistle blowers could not compete against the power to control the "news" maintained by Penn. Coupled with the use of the ad hominem strategies that drive efforts to deflect criticism, the community has failed to push back these dangerous and divisive Penn activities to recreate our neighborhood. Neighbors, please take action and send your IRS complaints now. Outside investigators not crazed by the jingle of fool's gold and plutocratic power over their neighbors will see the cover-up immediately. Sincerely, Glenn Moyer PS.
