Citizens, The good news is that the city hired a much more professional adjudicator. I had been told that some of the gang from 6 years ago, to which that nasty little man belonged, were put in jail.
Information to prep for court filing: Robert Carter is the supervisor in district 12, 3033 S. 63rd St. J Waites, badge number 948, Badge 947 (illegible signature), and C….. illegible badge and signature; were the “issuing officers” to ticket me in this latest round. Neighbors, throughout the city even beyond the ucd boundaries, where we have additional issues of corruption, it’s widely understood that the citizens are being harassed for “value judgments” and not code infractions. The example I gave of legal trash bags peeking above the top of the can and all of the tickets for legal items you may have on your porch, are nothing but value judgments and not code infractions. These officers are clearly given a mission to enhance revenue by coming back with violations. With nothing more specific than code 10-714-1 “premises must be clean and litter free,” they are arbitrarily harassing citizens. At least, there is a growing awareness that this seriously impacts the elderly, working poor, etc. causing very significant economic harm. (Yesterday, I described the potential harm in landlord/tenant relationships quietly occurring throughout the city.) And many of us may feel violated and intimidated by our government! Yesterday, I did not directly argue the issuing officer’s apparent value judgments but asserted the principle of demurrer. Restating the code or scribbling pathetic nonsense in the comments did not allow me to even be sure that I understand their ridiculous value judgments. I had to speculate because they summoned me to court without making any effort at asserting a legitimate specific violation. (eg. “you cannot store can recylabbbin or trash on the sidewalk”) I did not argue a case for 11/10/08 but insisted that I could only state the track record of my tenants. Anything else could not have been an honest defense because we are all denied the right to due process, since we receive these 4-6 months after the date. ( In municipal court the last time, the city prosecutor had the audacity to interject that my pictures did not represent the property at the time of the violation-hahaha) (Funny aside: The city is still officially claiming that the trash tickets are mailed to us within two months. I know that’s not true, you know that is not true, Carlton Williams knew that was not true when I tracked him down. City employees are supposed to look us in the eye and lie straight faced as we stand there with our tickets-hahaha). Neighbors, I’ve never done the filing to take the city to court in commonwealth court. The city is preparing to put people out of their homes because of the years the citizens have faced this arbitrary harassment. (You may not even know a debt is assessed against you. I just discovered one for high weeds in 2004. Fine amount $195, total due $257) The only hope we have to stop this is in the court.
