A work around I found for this problem is to use other names for submenus in the Help menu.
For example:
Documentation
the a divider line
About
I do not know why, but it works,

What's going on? Has this been discussed before? (not sure what to search on in the archives for it).
The About menu gets moved to it's correct spot under the apple menu (application menu in OS X).
??? That makes no sense. I didn't edit the Apple menu, I edited the Help
menu.
