On my setup (Mac 10.4.5, Rev 2.7), the keysDown doesn't seem to cover the escape key, or any other non-ascii key, unless an ascii key is also down...

Check out the entry for the keysDown function in the Transcript Dictionary; I believe that'll get you where you want to go....
