Because the EU has no problem with DRM, as such, but it does with proprietary DRM such as Apples. The thrust of the case seems to be to force Apple to license its "Fairplay" DRM to other companies to allow interoperability - currently, songs bought from the iTunes Store are playable only in iTunes and on iPods.

The shame of it is that the EU has missed the opportunity to attack DRM in general. Still, on the bright side, the major labels are pretty much condemning themselves to becoming simple catalogue companies, so these things will probably work themselves out anyway. IMO, of course :)
